December 18th, 2009 9:02 AM Canby PD to Enforce New Cell Phone Law On January 1st, 2010, officer's with the Canby Police Department will be enforcing the new cell phone law. House Bill 2377 prohibits all drivers from using a mobile communication device while operating a motor vehicle. A mobile communication device is defined as a "text messaging device or a wireless, two way communication device designed to receive and transmit voice or text communication." Under the new law, if you are over the age of 18, you may use a wireless device if you are using a hands free accessory that allows you to keep both hands on the wheel while you are driving. Drivers that are under the age of 18 may not use a wireless device in any case except specific situations such as an emergency or farming or agricultural operations. Like all hands free laws, the usual exceptions include emergencies, safety workers, person 18 years of age or older using a hands free accessory and emergency services personnel. Prior to this bill, only driver's under the age of 18 were prohibited from using a cell phone while they were driving. To read more details regarding this new law, please visit House Bill 2377.
