Canby Police Department Press Release
January 7th, 2008 12:52PM Canby man arrested for Attempting to Elude officers this morning. On Monday January 7, 2008, at about 12:23am, Canby Police Officer Scott Farmer saw a maroon GMC Jimmy sport utility vehicle come out of the driveway of the Royal Ascot Apartments in Canby at a high rate of speed. The driver of the Jimmy pulled out of the driveway onto Township Road traveling at the high rate of speed. This caused Officer Farmer to have to slow down to avoid a collision with the suspect vehicle. Officer Farmer began to follow the vehicle and observed it weaving in and out of it's lane of travel. Officer Farmer activated his emergency overhead lights in an attempt to stop the vehicle. The suspect vehicle failed to yield to Officer Farmer and continued westbound on Township. The pursuit of the suspect vehicle eventually ended at the intersection of SE 7th ave and S Pine Street when the suspect vehicle stopped.
The suspect, who was identified as JOSE EDUARDO GARCIA-AVILA DOB: 9-24-81 was taken into custody for Attempt to Elude, DUII, and Reckless Driving. GARCIA-AVILA'S BAC result was .21%. He was lodged at the Clackamas County Jail and the case is being referred to the Clackamas County District Attorney's Office.
