CANBY POLICE OFFICER ASSAULTED BY SUSPECT WHILE ASSISTING FIRE DEPARTMENT

On August 23, 2007 at 6:17pm, Canby Police Officers were dispatched to 300 S Locust Street in Canby to assist Canby Fire Medics with a subject that was causing a "ruckus" during a medical call they were on.

The subject was attempting to get into the apartment where the medics were working. At one point, the Medics were so concerned with the subjects behavior, they dead bolted the door and called for the police. The patient the medics were attending to told them he did not know who the subject was.

Officers arrived and were told that Canby Fire Medics were attending to a patient inside the residence while a subject named Joshua Aguila DOB: 5-3-79, was outside causing problems. Officers contacted Aguila, who was pacing back and forth, clenching his fists and mumbling incoherently. During this contact, Aguila attempted to walk into the apartment where the fire medics were working. Canby Police Officers told Aguila to come back away from the apartment. During this time, Aguila decided to walk into one of the officers and began to reach into his waistband.

Fearing that Aguila was reaching for a weapon Officers ordered him to show them his hands. Aguila refused to listen to the officers and continued to reach into his waistband. The officers who were fearing for their safety grabbed Aguila. While attempting to gain control of Aguila's hands, one of the officers was hit on the chin by the suspects fist. Officers continued to struggle with Aguila as he attempted to repeatedly hit the officers with his head and fists.

Officers ordered to Aguila to stop and he continued to fight them. Both officers deployed their tazers, striking Aguila. Aguila immediately complied with the officers and was taken into custody with no further incident. Aguila admitted to the officers that he was attempting to get rid of some methamphetamine he had in his waistband. He told officers he swallowed the methamphetamine and was under the influence of methamphetamine.

Aguila, who is a Norteno Gang Member, was not injured during this incident and was lodged at the Clackamas County Jail for Interfering with an EMT, Assaulting a Public Safety Officer, and five probation violations.

The Canby Police Officer who was assaulted was checked at a local hospital for a possible jaw injury and will be following up with another doctor later today.

The case is being referred to the Clackamas County District Attorney's Office.
